		<title><![CDATA[Investigator Notes]]></title>

		<description><![CDATA[<span style="color: rgb(0, 128, 0);"><b>INVESTIGATOR NOTES</b></span><div><br></div><div>1.&nbsp;  An AFCIA member frequently visits an Army base.&nbsp; The gate sentries have  requested that we pass the word about Investigators speeding up to and  through the gates.&nbsp; This particular base stated that they haven't  ticketed anyone, <u>yet</u> but be advised that they will soon begin doing so.&nbsp; Folks, this is a good way to get shot!&nbsp; Approach the gate very slowly and <b>STOP!</b>  unless waived through and proceed just as slowly.&nbsp; If a gate sentry  doesn't believe you intend on stopping, he/she is authorized to use  deadly force.&nbsp; The "line" where the federal / military installation has  jurisdiction doesn't begin "at" the gate.&nbsp; Usually it's a few yards  before entering the gate.&nbsp; <b>SLOW DOWN!</b> </div><div><br></div><div>2.&nbsp; <u>Investigators undergoing their own re-investigations</u>  are advised that an employee nor contract investigator may conduct  their investigation.&nbsp; Example:&nbsp; If you are a contract investigator  working for X Company (example: OmniSec, KeyPoint, CSC, ADC, USIS, CACI,  MSM, etc.) an employee investigator from X Company cannot conduct your  investigation nor can a contract investigator who contracts with X  Company conduct your investigation.&nbsp; It is a conflict of interest.&nbsp; It  may be an oversight on assignment and it's your responsibility to bring  it to the company's attention.&nbsp; </div><div><br></div><div>3.&nbsp; Again, know what an <u>independent contract investigator</u> is and know the rules for your State.&nbsp; If you have any questions, contact your State Department of Labor. </div><div><br></div><div>4.&nbsp; <u>Security Reminder</u>:&nbsp; Classified information (such as troop movement) will NOT be discussed over telephones, cell phones or e-mail.&nbsp; "Loose lips sink ships!" <br></div>]]></description>

		<title><![CDATA[MSM - Department of Labor]]></title>

		<description><![CDATA[<font face="times new roman, times, serif"><font size="3">I just  completed an e-mail&nbsp;questionnaire from Dept. of Labor regarding MSM.  Apparently they are investigating&nbsp;whether&nbsp;MSM is complying with the&nbsp;<span style="FONT-FAMILY: 'Times New Roman','serif'; FONT-SIZE: 12pt; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA">Fair  Labor Standards Act and the McNamara-O’Hara Service Contract Act. I  have mixed emotions about the company because they gave me first  credentials over 11 years ago. 		<title><![CDATA[PSI Investigators - PI License Not Required]]></title>

		<title><![CDATA[ADC]]></title>

		<description><![CDATA[<font face="Verdana" size="3">Lately, ADC, Ltd. has been difficult to deal with. I used to love working with them mainly because they paid so quickly and were so friendly on the phone.&nbsp; Now, I've been told that if I don't take a case for 90 days I will be taken off their rolls. I have also been asked to take cases and told they are in my area and when I receive the case there are many leads outside my area.&nbsp; I have been told to conduct leads that aren't required and when I tell them that it's not required, I'm told to do it anyway.&nbsp; I'm not a federal agent anymore and I don't work to placate others in their non-sense.&nbsp; <br><br>As I mentioned, I used to love working for them but they've become difficult.&nbsp; Anyone else having any problems with ADC, Ltd.?<br></font><br>]]></description>

		<description><![CDATA[Haven't had time to post this sooner and the more I think about this, the more it weighs on what is happenings to us field investigators. <br><br>So I get this offer from MSM saying that I can do these medical investigations for $35.&nbsp; No mistake -- $35.&nbsp; While I'm out there on other cases, I stop in and do this medical investigation for $35. Slap me hard. I figure that the next offer I'll get if to take out their trash for them. <br><br><br>]]></description>

		<description><![CDATA[<span style="font-family:Verdana; color:#000000; font-size:10pt;"><span style="font-family:Verdana; color:#000000; font-size:10pt;">Sources recently stated that USIS will be going through a  restructure, which will include possibly eliminating most mid-level  management positions&nbsp;(District Managers) and consolidating remaining  units. Apparently, USIS and Keypoint have engaged in alleged  "fraudulent" reporting of mileage reimbursements for many years and it is  surmised that these organizations may be penalized.&nbsp;Contingent upon&nbsp;the  severity of the contractual violations&nbsp;these companies could at the  worst lose thier contracts. USIS and Keypoint do not pay for mileage  reimbursement since investigators are paid a flat task-based fee,  however OPM/DHS pay for mileage. Investigators have never been required  to submit mileage numbers to either USIS or Keypoint, especially since  investigators are paid a flat fee for completed tasks. Sources say that USIS and Keypoint, in-spite of the fee based task equation, have  been submitting milage figures for reimbursement to&nbsp;OPM and DHS for many  years. The quick and simple, this represents possible fraudulent  reporting, leave alone receipt of federal reimbursement without  documentation. You are most likely aware that USIS and its stepchild,  Altegrity, CEO's recently resigned under duress, due most likely to the  aforementioned. Since so much information has been held in confidence  close to home-base the information we receive in the open may likely be  tainted or orchestrated by interested parties. Nonetheless, we should'nt  be alarmed or surprised if the worst for these organizations occurs. 		<description><![CDATA[I conduct most of my work in the Baton Rouge, LA area. &nbsp;The Baton Rouge metropolitan area falls primarily within the jurisdiction of the Baton Rouge Police Department and the East Baton Rouge Parish Sheriff's Office (EBRSO). &nbsp;This past summer, the EBRSO ceased providing criminal record checks and began referring investigators to the Louisiana State Police (LSP). &nbsp;Since that time, I've conducted perhaps a dozen criminal record checks at the LSP Headquarters in Baton Rouge. &nbsp;Each time I've done so, I've been asked by the LSP Criminal Records Analyst (CRA) conducting the search whether or not the check was "for national security purposes." &nbsp;Today, I was informed by one of LSP's CRA's that the LSP will no longer provide information regarding their criminal arrest records (which includes arrest records by most, if not all, of the local jurisdictions in the state) unless a fingerprint card on the subject of the investigation is furnished to them. &nbsp;I was told that the deciding official was the Commander of LSP Operational Development, who oversees, inter alia, LSP policy development and public affairs.<div><br></div><div>I was wondering if any other members have had similar problems and what they did about it. &nbsp;Is this the type of information that should be forwarded to each of the companies I work for. &nbsp;Does anyone know if these companies have previously furnished fingerprint cards to investigators similarly situated? &nbsp;Or is this just something that should be written up each time I submit my law checks?</div><div><br></div><div>I was also wondering if anyone has had to certify to a police department, formally or informally, that their check was being conducted for national security purposes.</div><div><br></div><div>Thanks for any feedback.<br><div><br></div><div><br></div></div>]]></description>

This applies even if you are given freedom of action. It would also require the agency to notify the Contractors' State License Board of a violator that is a licensed contractor, and require the board to initiate an action against the licensee. This bill would exempt from the provisions regarding joint and several liability a person who provides advice to his or<br> her employer or an attorney who provides legal advice in the course of practicing law.<br> The people of the State of California do enact as follows:<br style="mso-special-character: line-break"> <br style="mso-special-character:line-break"> </span></p>  <p style="margin:0in;margin-bottom:.0001pt"><span style="font-size:10.0pt; font-family:&quot;Verdana&quot;,&quot;sans-serif&quot;;color:black">SECTION 1. Section 226.8 is added to the Labor Code, to read:<br> 92<br> 226.8. (a) It is unlawful for any person or employer to engage in any<br> of the following activities:<br> (1) Willful misclassification of an individual as an independent contractor.<br> (2) Charging an individual who has been willfully misclassified as an<br> independent contractor a fee, or making any deductions from compensation,<br> for any purpose, including for goods, materials, space rental, services,<br> government licenses, repairs, equipment maintenance, or fines arising from<br> the individual's employment where any of the acts described in this<br> paragraph would have violated the law if the individual had not been<br> misclassified.<br> (b) If the Labor and Workforce Development Agency or a court issues<br> a determination that a person or employer has engaged in any of the<br> enumerated violations of subdivision (a), the person or employer shall be<br> subject to a civil penalty of not less than five thousand dollars ($5,000) and<br> not more than fifteen thousand dollars ($15,000) for each violation, in<br> addition to any other penalties or fines permitted by law.<br> (c) If the Labor and Workforce Development Agency or a court issues<br> a determination that a person or employer has engaged in any of the<br> enumerated violations of subdivision (a) and the person or employer has<br> engaged in or is engaging in a pattern or practice of these violations, the<br> person or employer shall be subject to a civil penalty of not less than ten<br> thousand dollars ($10,000) and not more than twenty-five thousand dollars<br> ($25,000) for each violation, in addition to any other penalties or fines<br> permitted by law.<br> (d) (1) If the Labor and Workforce Development Agency or a court<br> issues a determination that a person or employer that is a licensed contractor<br> pursuant to the Contractors' State License Law has violated subdivision (a),<br> the agency, in addition to any other remedy that has been ordered, shall<br> transmit a certified copy of the order to the Contractors' State License Board.<br> (2) The registrar of the Contractors' State License Board shall initiate<br> disciplinary action against a licensee within 30 days of receiving a certified<br> copy of an agency or court order that resulted in disbarment pursuant to<br> paragraph (1).<br> (e) If the Labor and Workforce Development Agency or a court issues<br> a determination that a person or employer has violated subdivision (a), the<br> agency or court, in addition to any other remedy that has been ordered, shall<br> order the person or employer to display prominently on its Internet Web<br> site, in an area which is accessible to all employees and the general public,<br> or, if the person or employer does not have an Internet Web site, to display<br> prominently in an area that is accessible to all employees and the general<br> public at each location where a violation of subdivision (a) occurred, a notice<br> that sets forth all of the following:<br> (1) That the Labor and Workforce Development Agency or a court, as<br> applicable, has found that the person or employer has committed a serious<br> violation of the law by engaging in the willful misclassification of<br> employees.<br> 92<br> Ch. 706 — 2 —<br> (2) That the person or employer has changed its business practices in<br> order to avoid committing further violations of this section.<br> (3) That any employee who believes that he or she is being misclassified<br> as an independent contractor may contact the Labor and Workforce<br> Development Agency. The notice shall include the mailing address, e-mail<br> address, and telephone number of the agency.<br> (4) That the notice is being posted pursuant to a state order.<br> (f) In addition to including the information specified in subdivision (e),<br> a person or employer also shall satisfy the following requirements in<br> preparing the notice:<br> (1) An officer shall sign the notice.<br> (2) It shall post the notice for one year commencing with the date of the<br> final decision and order.<br> (g) (1) In accordance with the procedures specified in Sections 98 to<br> 98.2, inclusive, the Labor Commissioner may issue a determination that a<br> person or employer has violated subdivision (a).<br> (2) If, upon inspection or investigation, the Labor Commissioner<br> determines that a person or employer has violated subdivision (a), the Labor<br> Commissioner may issue a citation to assess damages set forth in<br> subdivisions (b) and (c) in addition to any other penalties or damages that<br> are otherwise available at law. The procedures for issuing, contesting, and<br> enforcing judgments shall be the same as those set forth in Section 1197.1.<br> (3) The Labor Commissioner may enforce this section pursuant to Section<br> 98 or in a civil suit.<br> (h) Any administrative or civil penalty pursuant to subdivision (b) or (c)<br> or disciplinary action pursuant to subdivision (d) or (e) shall remain in effect<br> against any successor corporation, owner, or business entity that satisfies<br> both of the following:<br> (1) Has one or more of the same principals or officers as the person or<br> employer subject to the penalty or action.<br> (2) Is engaged in the same or a similar business as the person or employer<br> subject to the penalty or action.<br> (i) For purposes of this section, the following definitions apply:<br> (1) "Determination" means an order, decision, award, or citation issued<br> by an agency or a court of competent jurisdiction for which the time to<br> appeal has expired and for which no appeal is pending.<br> (2) "Labor and Workforce Development Agency" means the Labor and<br> Workforce Development Agency or any of its departments, divisions,<br> commissions, boards, or agencies.<br> (3) "Officer" means the chief executive officer, president, any vice<br> president in charge of a principal business unit, division, or function, or any<br> other officer of the corporation who performs a policymaking function. If<br> the employer is a partnership, "officer" means a partner. If the employer is<br> a sole proprietor, "officer" means the owner.<br> (4) "Willful misclassification" means avoiding employee status for an<br> individual by voluntarily and knowingly misclassifying that individual as<br> an independent contractor.<br> 92<br> — 3 — Ch. 706<br> (j) Nothing in this section is intended to limit any rights or remedies<br> otherwise available at law.<br> SEC. 2. Section 2753 is added to the Labor Code, to read:<br> 2753. (a) A person who, for money or other valuable consideration,<br> knowingly advises an employer to treat an individual as an independent<br> contractor to avoid employee status for that individual shall be jointly and<br> severally liable with the employer if the individual is found not to be an<br> independent contractor.<br> (b) This section does not apply to the following persons:<br> (1) A person who provides advice to his or her employer.<br> (2) An attorney authorized to practice law in California or another United<br> States jurisdiction who provides legal advice in the course of the practice<br> of law.</span></p>  ]]></description>
